    (Applicable Scope)

    Article 1

    • 1.Accommodation Contracts and other binding agreements related thereto between the Hotel and the Guest shall be as outlined in these General Terms & Conditions for Accommodation, and follow laws and regulations and/or generally accepted practices for all matters not outlined within.
    • 2.The Hotel, in responding to any special agreements that fall within the scope of the laws or regulations or generally accepted practices, the special agreement shall take precedence over the preceding Paragraph listed above.
    (Applications for Accommodation Contracts)

    Article 2

    • 1.A Guest who intends to apply for an Accommodation Contract with the Hotel shall submit the following particulars:
      (1) Guest name(s)
      (2) Date of accommodation and expected time of arrival
      (3) Accommodation charges (in principle, based on the basic accommodation charges listed in Appendix 1)
      (4) Any other items the Hotel requires
    • 2.If the Guest requests a continued stay beyond the accommodation stipulated in the Item 2 of the preceding Paragraph, the Hotel shall treat the Guest as having applied for an additional Accommodation Contract starting from the time of the request.
    (Conclusion of Accommodation Contracts and related agreement)

    Article 3

    • 1.Accommodation Contracts are considered established as of the Hotel's approval of an application as stipulated in the preceding Article. However, this does not apply to instances in which the Hotel proves that it did not approve of the application.
    • 2.Once an Accommodation Contract has been established in accordance with the provisions of the preceding Paragraph, the Guest is requested to pay an accommodation deposit prescribed by the Hotel within the limits of the basic accommodation charges covering the Guest’s accommodation period (or for 3 days worth, for periods of stay exceeding 3 days) by the date the Hotel defines.
    • 3.The accommodation deposit shall first be applied to the final amount the Guest has to pay for his/her accommodations. In case of events as defined by Article 6 and/or Article 18, payment shall first be applied to cancellation fees and compensation in that order. If any amount then remains, it shall then be returned at the time of payment as defined in Article 12.
    • 4.If payment for the accommodation deposit as stipulated in Article 2 is not made by the date specified by the Hotel, the Accommodation Contract immediately shall lose its effectiveness, but limited only to the case where the Hotel has notified the Guest to that effect at the time when prescribing the day due for payment of the accommodation deposit.
    (Special Agreements Requiring No Accommodation Deposit)

    Article 4

    • 1.Regardless of the provisions of the preceding Article, Paragraph 2, the Hotel may accept a special agreement that does not require accommodation deposit as specified under the same Paragraph after the contract is completed.
    • 2.Any Accommodation Contracts that are approved with no request by the Hotel for the accommodation deposit as stipulated in Paragraph 2 of the preceding Article, and/or those not given a defined payment deadline, shall be treated as special agreements prescribed in the preceding Paragraph.
    (Refusal of Accommodation Contracts)

    Article 5

    • 1.The Hotel may refuse to accept an Accommodation Contract for the following reasons.
      • (1) When an application for accommodation does not meet these Terms & Conditions for Accommodation.
      • (2) When there is no room available due to full occupancy.
      • (3) When the Guest seeking accommodation is considered likely to behave in violation of the provisions of the ordinance, public order, or good public morals in regard to his/her accommodation.
      • (4) When the Guest seeking accommodation is recognized to fall into the categories from A to C;
        • A.An organized crime group (hereafter "Organized Crime Group") as defined under Article 2 Item 2 of the Act on Prevention of Unjust Acts of Organized Crime Group Members (Act No. 77 of 1991), an organized crime group member (hereafter "Organized Crime Group Member") as defined under Article 2 Item 6 of the same Act, an associated member or a person linked to Organized Crime Group or any anti-social organizations;
        • B.A corporation or other organization of which business activities are under control of Organized Crime Group or Organized Crime Group Member; or
        • C.A corporate or other organization which its director is considered to be Organized Crime Group Member.
      • (5)When the Guest seeking accommodation is a noticeable nuisance to other Guests.
      • (6)When the Guest seeking accommodation is clearly recognized to be contagious.
      • (7)When a violent request for accommodation is made, or an unreasonable burden is demanded.
      • (8)When natural disasters, facility malfunctions, or other unavoidable circumstances make accommodation impossible.
      • (9)In accordance with Nagasaki Prefecture Ordinance No. 38 (Nagasaki Prefecture Nuisance Prevention Regulations).
    (Right to Cancel Accommodation Contracts by the Guest)

    Article 6

    • 1.The Guest may contact the Hotel and cancel the Accommodation Contract.
    • 2.The Hotel shall charge cancellation fees according to the provisions listed in Appendix 2 if the Guest cancels all or part of the Accommodation Contract for reasons attributable to the Guest (except when the Hotel has requested the payment of the accommodation deposit by prescribing the date due for such payment under the provision of Article 3 Paragraph 2, and the Guest has canceled the contract before making payment). However, for special agreements as defined in Article 4 Paragraph 1, in accordance with that agreement, payment of cancellation fees shall only be required upon cancellation of an Accommodation Contract if the Hotel had specified as much in advance.
    • 3.The Hotel may consider an Accommodation Contract canceled by the Guest if the Guest, without contacting the Hotel, does not arrive by 24:00 (or 1 hour after a scheduled arrival time if indicated by the Guest beforehand) on the day of his/her accommodation, and will be handled accordingly.
    (Right to Cancel Accommodation Contracts by the Hotel)

    Article 7

    • 1.The Hotel may cancel an Accommodation Contract for the following reasons. When the Guest is considered likely and/or has conducted himself/herself to behave in violation of the provisions of the ordinance, public order, or good public morals in regard to his/her accommodation;
      • (1)When the Guest is recognized to fall into the categories from A to C;
        • A.Organized Crime Group, Organized Crime Group Member, an associated member or a person linked to Organized Crime Group or any anti-social organizations;
        • B.A corporation or other organization of which business activities are under control of Organized Crime Group or Organized Crime Group Member; or
        • C.A corporate or other organization which its director is considered to be Organized Crime Group Member.
      • (2)When the Guest is a noticeable nuisance to other Guests.
      • (3)When the Guest is clearly recognized to be contagious.
      • (4)When a violent request for accommodation is made, or an unreasonable burden is demanded.
      • (5)When natural disasters or other unavoidable circumstances make accommodation impossible.
      • (6)In accordance with Nagasaki Prefecture Ordinance No. 38 (Nagasaki Prefecture Nuisance Prevention Regulations).
      • (7)When the Guest is found smoking in locations other than the Smoking Booth, tampering with fire-prevention equipment, or not observing the rules prohibiting certain actions specified under the Hotel Rules stipulated by the Hotel (only those pertaining to fire prevention).

    If the Hotel cancels an Accommodation Contract based on the preceding Paragraph, there will be no charge for accommodation services that the Guest has yet to receive.

    (Registration of Accommodation)

    Article 8

    • 1.The Guest is required to register the following information on the day of accommodation at the reception desk.
      (1) Guest name, age, gender, address, and occupation
      (2) For foreign Guests: nationality, passport number, port and date of entry in Japan
      (3) Date and expected time of departure
      (4) Any other particulars the Hotel requires
    • 2.If the Guest intends to pay the fee specified in Article 12 by other means such as travel check, voucher, credit card, or other non-monetary methods, such means of payment shall be shown in advance at the time of the registration prescribed in the preceding Paragraph.
    (Occupancy Hours of Guest Rooms)

    Article 9

    • 1.Guest rooms at the Hotel can be used from 14:00 until 11:00 the following day. However, the Guest staying for multiple days has access to the guest room at all times other than on the day of arrival and day of departure.
    • 2.The Hotel may comply with use of guest rooms outside of the hours specified above regardless of the provisions specified. In such circumstances the following additional charges shall be applied.
      (1) For up to 3 additional hours: 1,000 yen/hour
      (2) For time beyond 3 additional hours: Full room charge
    • 3.The room charge prescribed in the preceding Paragraph will be the standard room price.
    (Compliance with the Terms of Use)

    Article 10

    The Guest shall be required to comply with the Hotel Rules established by the Hotel and posted on the website.

    (Operating Hours)

    Article 11

    • 1.The Hotel's main facilities operate primarily on the following hours, and other operating hours are listed in the provided pamphlets, around the facility, and in the service directory found in each guest room.
      • (1)Reception & Cashier Service Hours:
        • A.Reception Desk Services (3F) Available 24 hours a day.
      • (2)Dining & Other Facilities Service Hours:
        • A.Breakfast (1F): 6:30 – 10:00
        • B.Public Bath (11F): 5:00 – 10:00, 16:00 – 24:00.
    • 2.The times listed in the preceding Paragraph may be changed due to unforeseeable circumstances. The Guest will be notified via appropriate means in such instances.
    (Payment of Accommodation Charges)

    Article 12

    • 1.Details of the accommodation charges, etc. payable by the Guest shall be as listed in Appendix 1.
    • 2.The Guest shall pay the accommodation charges, etc. as stated in the preceding Paragraph in Japanese currency or by other means such as travel check, voucher, credit card, or other non-monetary methods at the time of the Guest’s departure or upon request by the Hotel at the reception desk.
    • 3.In the case that the Guest decides of his/her own will not to stay at the Hotel after the Hotel provides the guest room for the Guest, the Guest will still be charged for the guest room.
    (Liabilities of the Hotel)

    Article 13

    • 1.The Hotel shall compensate the Guest for damage if the Hotel has caused such damage to the Guest in the fulfillment or the nonfulfillment of the standard Contract and/or related contracts. However, the same shall not apply if the reasons for damage are not attributable to the Hotel.
    • 2.The Hotel is covered by a Liability Insurance to cope with unexpected fires and/or other disasters.
    (Handling when unable to provide Contracted Rooms)

    Article 14

    • 1.If the Hotel cannot provide contracted guest room(s), the Hotel, with the consent of the Guest, shall arrange accommodation of the same standard elsewhere for the Guest insofar as possible.
    • 2.If, in spite of the provision of the preceding Paragraph, the Hotel cannot arrange other accommodations, the Hotel shall pay compensation, equivalent to the cancellation fee to the Guest, which will be applied to the amount of the compensable damage. However, no compensation shall be paid if the reason for the guest room's unavailability cannot be attributed to the Hotel.
    (Handling of Entrusted Articles)

    Article 15

    The Hotel shall compensate for any loss or damage of any articles, cash, or valuables the Guest has checked in at the reception desk or brought into the hotel when it can be proved that these items were lost or damaged intentionally or by negligence on the part of the Hotel. In regard to items not notified of the description or value by the Guest in advance, the Hotel shall compensate up to a maximum of 50,000 yen unless they were lost or damaged intentionally or by negligence on the part of the Hotel.

    (Custody of Baggage and/or Belongings of the Guest)

    Article 16

    • 1.The Hotel shall only be liable to handle guest luggage sent to the Hotel before the Guest's arrival when the Hotel has agreed to such before the luggage arrives. Such luggage shall be handed over to the Guest at the reception desk at the time of check in.
    • 2.If, after the Guest has checked out of the Hotel, it becomes apparent that the Guest has left behind luggage or other belongings, items regarded as valuable by the Hotel, such as cash, will be held for a period of up to 7 days including the day they were found before being turned over to the nearest police station. Other items will be held for a month. Drinks, food, newspapers, magazines, umbrellas or other items regarded as trash by the Hotel will be disposed the next day.
    • 3.The Hotel's liability for holding Guest luggage and belongings shall, in situations covered in Paragraphs 1 and 2, follow the provisions of the preceding Article.
    (Liability in regard to Parking)

    Article 17

    Note that the Hotel will not be held liable for any damage to vehicles of Guest(s) or other property caused as a result of natural disasters and calamities, fire, theft, or other accidents occurring within its partnered parking lots. The Guest should be particularly wary of keeping his/her valuables safe. However the Hotel will be liable for compensation if the damage is caused by the Hotel's intention or fault.

    (Liability of the Guest)

    Article 18

    The Guest will be held liable for damages made to the Hotel whether intentional or due to negligence, and will be required to compensate to the Hotel for the said damage.

    (Liability of the Booking Guest)

    Article 19

    The Booking Guest is expected to have done the following upon making a reservation.

      • (1)State that the Booking Guest is entitled to obligate all accompanying guests under the reservation to comply with the Hotel Rules.
      • (2)Confirm that the minute information of all guests provided upon reservation is complete and accurate.
      • (3)Confirm that the Booking Guest has read through the Hotel Rules, understood it, and agrees to comply with it (on behalf of all of the guests under the reservation). Confirm that the Booking Guest has read through the Privacy Policy posted on our website. Confirm that the Booking Guest presents our Privacy Policy to all of the guests under the reservation.
      • (4)Confirm that the Booking Guest is over the age of 18 and indicate that the Booking Guest as well as all accompanying guests are of appropriate age when ordering services with age restrictions.

    Article 20

    Appendix 1 Breakdown of Accommodation Charges, etc. (As Described in Article 2 Paragraph 1 & Article 12 Paragraph 1)

    Note 1: Percentages for cancellation fees are based on the basic accommodation charges at the time the Accommodation Contract is made.
    Note 2: If the duration of stay is shortened, cancellation fees will not be collected for all shortened days, but just for 1 day (first day).
    Note 3: This is not the case for reservations made under special agreements.
    Note 4: This does not apply for situations due to the weather or other force majeure.
    Note 5: Concerning reservations of more than 20 rooms, if a partial cancellation of the reservation is made before 14 days prior to the arrival date (or in case the reservation is made within 14 days to the arrival date, on that reservation day), there will be no cancellation fees of 20% (rounded up in case of fractional numbers) for the cancelled room.
